Terms and Conditions

  1. The Offer is promoted by Alliance Developments Management Pty Ltd (ACN 111 695 240) trading as Nicheliving and its related bodies corporate (collectively, Nicheliving).
  2. Participation in the Offer is deemed acceptance of these Terms and Conditions.
  3. The Offer commences at 08:00am (Australian Western Standard Time) on Saturday 28th September 2019 and closes at 8:00am on Tuesday the 1st October 2019 (Australian Western Standard Time).
  4. The Offer is available on Nicheliving house and land packages (Nicheliving Packages) only.
  5. The Offer is not available to buyers on existing contracts (preliminary or finalised) for the purchase of house and land packages with Nicheliving.
  6. If a Buyer is successful in redeeming the Offer, Nicheliving agrees to give a Ford and Doonan air-conditioning system valued up to $12,000 to the Buyer.
  7. If the Buyer does not complete settlement on his or her Nicheliving Package, then the Offer is void.
  8. There is a limit of one Offer per person.
  9. The Offer may not be redeemed in conjunction with any other offer.
  10. Nicheliving reserves the right to alter or amend these Terms and Conditions at its discretion.
  11. Nicheliving’s decision on any matter is final and binding and no correspondence will be entered into.
  12. Nicheliving collects personal information about people, including Buyers, in compliance with its Privacy Policy, which is found at http://www.nicheliving.com.au/Privacy-Policy. Nicheliving collects personal information to promote, administer and manage applications for the Offer (which may include disclosure to third parties for the purpose of processing and conducting the Offer) and for the purposes of administering and expanding Nicheliving’s business activities, providing customer service and making available other products and services to buyers and prospective buyers in accordance with its Privacy Policy, but no further use of this information will be made without Buyers’ prior consent.
  13. Except for any liability that cannot be excluded by law, Nicheliving (including its officers, employees, servants, consultants, contractors, advisers and agents) excludes all liability for any loss or damage (including loss of opportunity) of any kind whatever, whether direct, indirect, special or consequential, arising out of the Offer.
  14. Any notice to be given or made pursuant to these Terms and Conditions to Nicheliving by Buyers must be in writing in English and must be served by email to enquiries@nicheliving.com.au.
  15. The agreement created pursuant to these Terms and Conditions is subject to the laws of Western Australia, and the Buyer and Nicheliving submit to the non-exclusive jurisdiction of the courts of that state.
  16. If a provision of these Terms and Conditions is invalid, illegal or unenforceable, then to the extent of that invalidity, illegality or unenforceability, that provision is severed from these Terms and Conditions and all other provisions remain in full force and effect.

The following terms and conditions are issued by Australian Property Alliance Pty Ltd (Nicheliving) and apply to the Stamp Duty promotion being offered by Nicheliving (Promotion):
1.  This Promotion commences on 30th October 2019 and ends on 30th December 2019 (or such other date determined by Nicheliving in its absolute discretion) (Promotion Period).
2.   This Promotion applies in respect of contracts entered into during the Promotion Period (Eligible Contract) for the sale and purchase of the following categories of Nicheliving properties: (a) Nicheliving off-the-plan apartments for a new residential unit or apartment in a multi-tiered structure (being a vertical development other than a single-tier strata scheme as defined by section 3(1) of the Strata Titles Act 1985 (Off-the-plan Apartment); and (b)selected Nicheliving home and land packages as determined in Nicheliving’s absolute discretion as a property to which this Promotion applies and as confirmed in writing by Nicheliving to the Buyer at the date of entry into an Eligible Contract, (each an Eligible Property).
3. The Promotion is available to the buyer of an Eligible Property under an Eligible Contract, if the buyer is a foreign person as defined by section 205A of the Duties Act 2008 (Eligible Buyer), then the promotion only applies to selected apartment dwellings and not house and land. (Eligible Buyer).
4. The Promotion contemplates Nicheliving discounting the value of any Eligible Property under an Eligible Contract by an amount determined by reference to the transfer duty that would have been payable on the Eligible Contract based on the purchase price of the Eligible Property prior to any deduction made under this Promotion (Applicable Transfer Duty).
5.  The key terms of the Promotion are as follows:

1. Nicheliving will, in respect of any Eligible Contract entered into for any Eligible Property by an Eligible Buyer, discount the purchase price of the Eligible Property by an amount equal to 2. 100% of the value of the Applicable Transfer Duty where the Eligible Property is an Off-the-plan Apartment and Nicheliving determines that the Eligible Buyer would not otherwise be eligible for an off-the-plan duty rebate offered by the Office of State Revenue in Western Australia; and 3. in all other cases, 25% of the Applicable Transfer Duty. 4. This maximum discount that Nicheliving will apply to any Eligible Property on account of the value of Applicable Transfer Duty is $10,000

6. This Promotion does not apply in conjunction with any other offer made by Nicheliving or its related bodies corporate.
